Acting Chair Pete Jones calls the public hearing to order at 7:42 p.m. PRESENT: Vice-Chair Pete Jones, Selectmen Representative Ken Curley, Roger LeClerc, and Herb Johnson. VOTING DESIGNATION: Vice-Chair Pete Jones, Selectmen Representative Ken Curley, Roger LeClerc, and Herb Johnson. ABSENT: Robert Fletcher, Scott Campbell, Alternates Victoria Parmele, and Eric Reitter Mr. Jones reads the public notice into the record and opens the public hearing. Mr. Jones states that the document for the record is titled “2009 Proposed Ordinance Changes Final Version 1/8/09...for the 2/2/09 Public Hearing.” Mr. Jones reads proposed Amendment 1 re: section 7.00 definitions of daycare. There are no comments from the public. Ms. Planchet notes that there were no changes proposed from the first public hearing. Mr. Jones reads proposed Amendment 2 stating that the old language is that “this shall be undertaken” and then reads the new language to be “This boundary shall be delineated and identified as a jurisdictional boundary (delete “shall be undertaken&rdquo by a licensed wetland scientist.” Mr. Jones specifies that the words “licensed soil scientist” are proposed to be deleted as a result of the January 14 public hearing. There are no comments from the public. Mr. Jones reads proposed Amendment 3 into the record and indicates the old language to be amended to be: “Driveway crossings and culverts for a single-family or two-family residential structure and its accessory uses, provided all state permits are obtained.” There are no comments from the public. Mr. Jones states that proposed amendments 4 and 5 were tabled at the prior public hearing. Mr. Jones closes the public hearing. The board discusses the proposed changes. Ms. Planchet states that legal counsel has reviewed these proposals and recommends that the word “its” be changed to “their” in amendment 3. Mr. Johnson suggests deleting the word “or” in amendment 2 since it’s no longer necessary. Ken Curley makes a motion to delete the word “or” from amendment 2; seconded by Herb Johnson. Motion passes 4/0. Ken Curley makes a motion to change the word “its” to “their” in amendment 3; seconded by Herb Johnson. Motion passes 4/0. Ken Curley makes a motion that the board submits all these amendments, 1, 2 and 3 to the ballot; seconded by Herb Johnson. Motion carries 4/0. Mr. Curley states that he has some informational items for the board. Relative to the Gleason deed, the transfer now has the signature of two selectmen so it should be good to proceed. Mr. Curley mentions that for the Bulls Gap application on Pine and Oak Street, the board of selectmen approved the application at its last meeting.
