Zoning Board of Adjustments

December 18, 2006

Chairman Farr calls the meeting to order at 7:00 p.m.
 
PRESENT: Chairman Bruce Farr, Thomas Lavigne, Nona Holmes, Alternates Jean Lane and Andrea Korson, Board Administrator Linda Smith.

ABSENT: Vice-Chairman Roy Pender, Robert Bailey, Alternate Ken Wilkins.

VOTING MEMBERS: Bruce Farr, Tom Lavigne, Nona Holmes, Jean Lane, and Andrea Korson.

APPLICATIONS:
OLD CASE:
Case #06-14: Lorie Jean, 39 Elm St. Map 123; Lot 23. Applicant is seeking a variance to Article 3.01(A) and Article 3.02(B) to construct a 28? x 32? dwelling on a non-conforming lot of .11 Ac. with no road frontage. Continued from 7/24/06. Ms. Jean is not present; however, has requested a continuance.

Abutter Ken Peters is present. Mr. Peters states that this application process began back in June and asks how many continuances the board will allow. Ms. Smith states that she has spoken with Ms. Jean and there are circumstances that affect her from further continuing with the process. Mr. Farr states that the board does try to help applicants whenever possible; however, the abutter does have a valid point. Ms. Smith states that a letter was sent to Ms. Jean in October regarding another continuance of the case. Mr. Farr reads the October letter, which states that the board would motion to deny the application if the required information was not received. Tom Lavigne makes a motion, second by Jean Lane, to deny the request to continue Case 06-14. Mr. Farr states that this has exceeded four months and the board did notify the applicant; she does have the right to reapply. Motion passes unanimously; 5/0. Tom Lavigne makes a motion, second by Jean Lane, to deny the application without prejudice, due to the lack of information. Motion passes unanimously; 5/0.

OLD CASE:
Case #06-33: David Docko, First NH Tpke. Map 211; Lot 16. Applicant is seeking a variance to Article 5.02(C) to develop a quarry for a non residential use where single family residential uses or municipal wells are the permitted uses within this district. (Property currently owned by Paul and John Tudor, and Carol Bernazzani.) [Continued from October 23, 2006. >

No abutters are present. Mr. Docko explains that he is still working with the Northwood Conservation Commission (NCC). He states that the NCC has expressed concern regarding setting a precedent by allowing the project to proceed in an area where there is an aquifer in the Great Woods. He states that he his planning to have a representative from the explosive company attend the next NCC meeting to discuss issues relative to the aquifer and the affects that the business will have on the aquifer, if any. He adds that they are not sure of the actual location of the aquifer.

Ms. Lane asks how big the quarry will be. Mr. Docko replies that the area when completed may cover 4 acres. Mr. Lavigne asks what the general feeling was of the conservation commission. Mr. Docko replies that the NCC chair was not at the last meeting and the issue will be discussed at the next meeting. Mr. Docko requests a continuance of the case.

Ms. Korson makes a motion, second by Jean Lane, to continue the case to the next regular meeting at the applicant?s request, to allow the applicant to satisfy the NCC with information that this board will be using in their deliberations on the case. Motion passes unanimously; 5/0.  

Tom Lavigne makes a motion, second by Andrea Korson, to continue the minutes to the next regular meeting. Motion passes unanimously; 5/0.

Jean Lane makes a motion, second by Nona Holmes, to adjourn. Motion passes unanimously. Motion passes unanimously; 5/0.
